CONTEST RULES

Article 1: Organizing company

From 1 September 2008 until further notice, Association Pink Lady® Europe, 436, avenue Charles de Gaulle 84100 ORANGE – FRANCE - Tel: +33 (0)4 90 11 91 80 - Fax: +33 (0)4 32.81.13.31, SIRET: 421 352 550 000 22, VAT No: FR 2842 13 52 550, is organising on its website www.pinkladyeurope.com a European contest called "Vote for Pink Lady®", with a draw every 6 months.

Article 2 : Conditions and procedures of participation

Entrants are deemed to have accepted these rules and regulations unreservedly.
This contest, which is free and includes no obligation to purchase, is open to adults with the exception of the Organizers’ staff and their relatives.
Participation in the contest is subject to the terms and conditions set out in the regulations.
Written or telephone enquiries regarding the interpretation or conduct of this competition will not be answered.

The organizing company may directly or indirectly perform all necessary verifications in order to check the eligibility of the entrants.

To participate, simply:
 
  • Connect to the www.pinkladyeurope.com website
  • Register by following the instructions on the site. To register, first provide your e-mail address and then fill in the online form (title, surname, first name, city, address, postal code, birth date, telephone and password).
  • Entrants must then upload the digital photograph they wish to enter in the contest. This photo must contain a Pink Lady® apple with its sticker. This photo must be in colour or black and white, in JPEG format exclusively, with a maximum size of 2 Mb. It is understood that the photo will not be returned to the entrant and it may be used by the organisers pursuant to the terms and conditions stipulated in these regulations. Any fraudulent use will be subject to legal proceedings.
  • Entrants must fill in all the fields of the registration form. No incomplete forms or forms containing false, incorrect or inaccurate information concerning the identity or address of the entrant, and no photos failing to meet the size and format criteria indicated in the form and the regulations will be accepted for contest entry.
  • The entrant warrants that that the photo submitted for the contest is the original work of the entrant

The following types of photographs shall be rejected and not published:
 
  • Photos that are contrary to the image of Pink Lady®
  • Photos in formats other than JPEG and/or sizes larger than 2 Mb.
  • Photos that are vulgar
  • Photos that are defamatory
  • Photos that infringe applicable laws
  • Photos that are indecent and/or against public policy
  • Photos that incite racist hatred
  • Photos that violate in any way whatsoever the rights of third parties, and in particular the right to privacy (name, image, etc.)
  • Photos representing an element subject to intellectual or industrial property rights, such as an original work, a brand (other than Pink Lady®), a registered design, etc.

- Amongst the valid entries, the 6 photos with the highest scores win the contest.

- No inaccurate or incomplete registrations will be taken into account or deemed valid. The same penalty applies in case of multiple entries.
Registration for the contest is only performed electronically, using the online registration form. No phoned-in, faxed-in or e-mailed entries other than the online registration form will be accepted.

 

Article 3: Voting

Photographs complying with these regulations will be displayed on the home page of the website and in the photo gallery as soon as they have been validated by the moderator and submitted for online voting.
The photos in the photo gallery may be sorted by the "most recent" or by the "best rated" (in case of a tie, the photographs will be classified from the most recent to the least recent).

To vote for your favourite photo:
 
  • Connect to the www.pinkladyeurope.com website and click on photo contest or competition.
  • Enter your username (valid e-mail) and your password
  • Go to the "vote" section where the photographs are displayed.
  • To vote for a photograph, click on the stars located below the photograph.

You can vote for several photographs, but you can only vote for the same photograph once.

 

Article 4: Prize value

The prizes (6 sets every 6 months) offered:
 
  • "Pink Lady" music CD with a net retail value of approximately 15 euro
  • Tote bags with a net retail value of approximately 10 euro
  • In the event of stock-out, Pink Lady® reserves the right to provide a different prize with a retail value of 10 to 15 euros.

 

Article 5: Modification or cancellation of the contest

Association Pink Lady® Europe reserves:
 
* The right to cancel or modify this contest for technical reasons or for updating.

Association Pink Lady® Europe reserves the right to replace the winner’s prize with another article of the same type and value without Association Pink Lady® Europe being in any way liable.

 

Article 6: Publication and Awarding of Prizes

The winner shall be notified every 6 months, by e-mail at the address indicated in their contest registration form (entrants are required to manage their e-mail address accounts properly).
The procedures for awarding the prizes shall be stipulated in this e-mail message. The names of the winners as well as the winning photos shall also be indicated on the www.pinkladyeurope.com website.

It is then the winners’ responsibility to follow the procedures to receive the prize, indicated in the e-mail notifying them that they have won, within 15 days from sending of this e-mail. Otherwise, the prize will be forfeited and the winner will no longer be able to claim a prize.

The organising company reserves the right to verify the accuracy of the information provided upon registration, prior to awarding the prize to the winner. The prize may not be exchanged or refunded in all or in part and may not be transferred to third parties.

 

Article 7: Authorisation of the winner

The winner authorises Association Pink Lady® Europe to use his or her name and the photo in all advertising/promotional activities in connection with the contest, without such use entitling the winner to any other rights than the prize awarded.

 

Article 8: French Privacy and Data Protection Act

Association Pink Lady® Europe is the sole recipient of the personal information provided. The contact details of the entrants and of the winner will be processed electronically.

In accordance with the loi informatique et liberté (French privacy and data protection act) dated 6 January 1978, entrants are entitled to access, rectify or delete any information concerning them, on written request sent to the competition address :

Article 9: Liability and force majeure

The organising company shall not be held liable for any misuse of the information, due to the nature of the Internet.

The organising company shall not be held liable in the event of any kind of technical failures or anomalies in connection with hardware or software (viruses etc.) caused on the entrant’s system, computer equipment or the data stored therein, or for the consequences that may arise for the entrant’s personal or commercial activity.

 

Article 10: Interpretation of the regulations

"All entries for this competition imply the unreserved acceptance of these Rules and competition procedures by the entrants.

The rules governing this competition are subject to French law and any dispute in relation to their application will be handled by the French courts.

Written or telephone enquiries regarding the interpretation or application of these Rules & Regulations operation, the competition’s procedures and mechanisms or the list of winners will not be answered.

The Organizers reserve the right to institute legal proceedings against anyone guilty of cheating in this competition.

These regulations will be available online at www.pinkladyeurope.com and may be consulted by all entrants.
